My Bad Day provides emotional wellness support through digital tools and personalized content. Our service includes:

  • AI-powered features and generated content (with your consent)

2. Important Health and Medical Disclaimers

IMPORTANT NOTICE:

Our service is NOT a substitute for professional medical, psychological, or psychiatric care. If you are experiencing a mental health crisis or having thoughts of self-harm, please contact emergency services immediately or call a mental health crisis hotline.

  • Our content and recommendations are for informational and educational purposes only
  • AI-generated content may be inaccurate, incomplete, or inappropriate. Do not rely on AI features for medical or mental health advice

3. User Responsibilities and Eligibility

  • You must be at least 14 years old (or the age required by your country's law, whichever is higher) to use our service
  • Provide accurate information during registration and use
  • Maintain account security and keep login credentials confidential
  • Use the service in compliance with applicable laws and regulations
  • Respect the privacy and rights of others, including through the partner sharing feature
  • Not attempt to reverse engineer, hack, or interfere with our service

4. Subscription & Payments

Free Trial:

  • New users receive a 30-day free trial of premium features
  • Your subscription begins automatically when the trial ends unless you cancel before then
  • Cancel anytime during the trial to avoid charges

Subscription Terms:

  • Core features remain free; premium upgrades available for advanced analytics and AI insights
  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
  • Cancel your subscription at any time through your device's subscription settings (App Store or Google Play)
  • We will notify you of any price changes at least 30 days in advance

Refund Policy:

  • All payments are processed through Apple App Store, Google Play Store, or our subscription management provider
  • Refund requests can be submitted directly through the app or by contacting us at contact@mybadday.app
  • Refunds are evaluated on a case-by-case basis and subject to applicable app store policies
  • EU consumers have a 14-day withdrawal right for digital content, which may apply to initial subscription purchases

5. Intellectual Property

  • All content, technology, and materials in our service are owned by us or our licensors and protected by intellectual property laws
  • You retain ownership of your personal content (journal entries, mood data, notes)
  • You grant us a limited license to process your data solely to provide the service features you use
  • You may not copy, modify, distribute, or create derivative works from our proprietary content

6. Account Termination

Your Right to Terminate:

  • You may delete your account at any time
  • Upon account deletion, your data will be permanently deleted with no possibility of recovery

We may suspend or terminate accounts immediately for violations of these terms, including but not limited to:

  • Harassment or abusive behavior toward other users (including through partner sharing)
  • Illegal activity or use of the service for unlawful purposes
  • Security violations, hacking attempts, or reverse engineering
  • Creating spam accounts or attempting to abuse our service
  • Any conduct that harms other users or the integrity of our service

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE PROVIDE OUR SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

  • We do not guarantee uninterrupted, error-free, or secure service
  • We are not responsible for data loss, though we make reasonable efforts to prevent it
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICE
  • This includes damages for loss of profits, data, goodwill, or other intangible losses
  • You use our service at your own risk

8. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:

  • Third-party service failures (cloud infrastructure, AI providers, payment processors)
  • Natural disasters, pandemics, or public health emergencies
  • Government actions, war, terrorism, or civil unrest
  • Internet or telecommunications failures
  • Power outages or equipment failures

9. Changes to Terms

We may update these terms from time to time. For minor changes, we will update the "Last Updated" date and changes will be effective immediately upon posting. For material changes, we will notify you by:

  • Posting the new terms on this page
  • Sending an email notification
  • In-app notification

Continued use of the service after changes constitutes acceptance of the new terms.

10. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the Republic of Lithuania and the European Union.

Dispute Resolution:

  • Any disputes will be subject to the jurisdiction of Lithuanian courts
  • EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
